Writing a patent application

A patent application combines technology and law – specific implementations and general definitions. Often the initial idea resulting in a patent is conceived by a technician and, of course, patents/patent applications are often read by technicians. However, in the event of a legal action, a judge not having a technical background must also be able to read and understand the patent. A patent shall provide the broadest protection possible for an invention but, at the same time, high technical quality is required. Therefore, a patent application shall not be drafted as a manual or a scientific paper, nor must it be comprised of generalisations and unrealistic ideas. A thorough exchange of information between the developer(s) and the patent attorney is necessary in order to draft the best patent applications.

There are specific rules governing the form and contents of a patent application. If you plan to draft your own patent application, instructions may be found at The Danish Patent and Trademark Office.
