Finding a patentA number of considerations need to be made in connection with new inventions. Before embarking on expensive development, production or patenting processes, it is important to find out if another inventor holds a patent for a similar product or procedure. In other words, we recommend that you make a patentability search. Companies or individuals making a new invention are often experts within their own field(s). It might be a good idea to set up a search profile for your invention and make a patentability search. Your search should include patent databases as well as a generel search on the Internet. If an invention has already been described in a patent or on the Internet, your invention does not meet the novelty requirement and a patent on that invention would not be valid. As mentioned above, you can make a patentability search yourself (see relevant databases on the menu to the left). However, such a search should only be used as a guideline. Our patent attorneys are experts in patent searching and assessment. The patent attorney identifies patents or other publications relevant to the novelty and inventiveness of your product or process. If such patents are infringed by your invention, the patent attorney will see if it is possible to 'design around' the invention and thus avoid infringement. |
