Priority rightWhen filing a utility model application, a priority right is established entitling the applicant to file a subsequent application for the same invention in other countries not later than 12 months after filing the original application. Consequently, the prior art which is taken into account for examining the novelty of the invention would not be everything made available to the public before the filing date of the subsequent application but everything made available to the public before the priority date, i.e. the date of filing of the original application. Thus, the priority right entitles you to file a subsequent utility model application or a patent application in Denmark or abroad.
